- actions taken with authorisation from the subject of the investigation or under their knowledge
Penalties for being involved in private investigations without licensing will be.
- upon the instant judgment at a Magistrate’s Court, District Court or Sheriff Court, a maximum punishment of six months imprisonment and/or a fine of up to £5,000
Charges for engaging unlicensed personnel will be.
- The biggest punishment of six months imprisonment and / or a fine of up to £5,000, after summary conviction at a Magistrate’s Court, Sheriff Court or District Court
- upon judgment on accusation at Crown Court, High Court of Justiciary or Sheriff and jury trial, up to five years imprisonment and/or an unlimited fine
