  • activities that are only related to credit the public record registers; published works; and records or registers which somebody can rightfully access
  • actions taken with authorisation from the subject of the investigation or under their knowledge

Penalties

Penalties for being involved in private investigations without licensing will be.

  • upon the instant judgment at a Magistrate’s Court, District Court or Sheriff Court, a maximum punishment of six months imprisonment and/or a fine of up to £5,000

Charges for engaging unlicensed personnel will be.

  • The biggest punishment of six months imprisonment and / or a fine of up to £5,000, after summary conviction at a Magistrate’s Court, Sheriff Court or District Court
  • upon judgment on accusation at Crown Court, High Court of Justiciary or Sheriff and jury trial, up to five years imprisonment and/or an unlimited fine
