The Government’s plan for the Security Industry Authority (SIA) to regulate private detective business was declared in 201 by the Home Secretary and includes Private Investigator Hastings in Sussex. Whether the Home Office will also want us to regulate ‘in-house’ private investigations is still unknown.
In the provisions of the Private Security Industry Act 2001, corporate bodies with a directorship, directors of parent companies, shadow directors, non-executive and executive directors are all regarded as “directors” alike.
The following acts, as stated in the Act, will not be needing a license.

  • services only concentrating on market research
  • activities particularly concerned with a credit check
  • expert activities of working solicitors and Barristers
  • professional activities of practicing accountants
  • professional services offered by journalists and newscasters, services to gather news by journalists and newscasters
  • activities that are only related to credit the public record registers; published works; and records or registers which somebody can rightfully access
  • actions taken with authorisation from the subject of the investigation or under their knowledge

Sanctions

Penalties for being involved in private investigations without licensing will be.

  • The biggest punishment of six months imprisonment and / or a fine no bigger than £5,000, after summary conviction at a Magistrate’s Court, Sheriff Court or District Court

When one supplies staff that is not licensed, the penalty will be.

  • If convicted by a Magistrate’s Court, Sheriff Court or District Court, a maximum sentence of six months in prison and/or a fine of £5,000.
  • having been convicted after prosecution at a Higher Court, Crown Court, Sheriff or a Justiciary and any trial involving a jury, the maximum penalty will be imprisonment for 5 months and / or fine that is unlimited ( at the discretion of the court)
