The Government’s plan for the Security Industry Authority (SIA) to regulate private detective business was declared in 201 by the Home Secretary and includes Private Detective Newport in Gwent. In December 2014, another announcement was made by the Home Office saying that the Government expects the establishment of a statutory licensing of private inspection activities to come into force as quickly as possible during the next Parliamentary session, which started in May 2015. The following activities will not need a licence as per the Act.

  • activities that are meant for market research alone
  • services to determine credit worthiness
  • practicing barristers and solicitors’ professional activities
  • professional services offered by accountants
  • professional undertakings by journalists and broadcasters, and actions solely connected to gathering information for use in broadcasting and journalism
  • services offered to the public contained in open registers; registers or documents fully accessible to individuals; and material that has been made public
  • actions taken with authorisation from the subject of the investigation or under their knowledge

Penalties

If one is caught offering private investigation services without a license they will be charged as follows.

  • The biggest punishment of six months imprisonment and / or a fine no bigger than £5,000, after summary conviction at a Magistrate’s Court, Sheriff Court or District Court

Charges for engaging unlicensed personnel will be.

  • If convicted by a Magistrate’s Court, Sheriff Court or District Court, a maximum sentence of six months in prison and/or a fine of £5,000.
  • A fine of unlimited degree or a five years imprisonment will be given when the person is convicted upon indictment at a Sheriff and jury trial, High Court of Justiciary or a Crown Court
